How it works

How it works

  1. 01Payment claimThe amount claimed as due, set out against the contract and the records.
  2. 02Payment scheduleThe respondent’s answer to the payment claim, within the prescribed time.
  3. 03ApplicationWe prepare adjudication applications for claimants and adjudication responses for respondents, under the security of payment Act that applies.
  4. 04DeterminationA fast, interim decision on the payment claim: binding in the meantime, while final rights can still be decided in arbitration or the courts.

The steps are illustrative; the contract, the rules and the tribunal govern each matter.

Applications and responses

Payment claims we prepare and answer

We prepare adjudication applications for claimants and adjudication responses for respondents, under whichever security of payment Act applies. Adjudication gives a fast, interim decision on a payment claim: binding in the meantime, while final rights can still be decided in arbitration or the courts.

01Progress payments
The amount due on a payment claim, set out against the contract and the records.
02Variations
The value of varied or extra work, and whether it falls within the contract scope.
03Time-related costs
Extension of time and delay costs, where the contract allows them in a payment claim.
04Set-off and back-charges
Whether amounts withheld are supported by the contract and the records.
05Subcontract payments
Claims between head contractors and subcontractors, and further down the chain to suppliers.

The Act sets short deadlines, so we work to them from day one. Sitting as adjudicator is a different role: it is a statutory appointment held personally, and our principal is a registered adjudicator in the states and territories where registered and appointed.
